netniV Mar 14, 2004, 13:14 So, have you guys ever gone after compensation ? "Had an accident at work ? Not your fault ?" you know the usual bull shite that they spout on the adverts.
Well, ordinarily if it was a genuine accident I wouldn't bother, but having taken several days off work and knowing that it was more his fault than mine, it left me wondering...
Who would be the best to go with and why ?

Any local solicitor will grant you a nominal fixed fee interview to assess the merit of your claim, shop around locally and you may even find a solicitor who will grant the initial interview for free.
Beware the "No win, no fee" claims, of the organizations that advertise on TV, they're total bullshit. The No Fee only applies to the broker organisation, it does not cover 'additional costs'. Basically you will be expected to take out an insurance policy to underwrite the eventuality of losing the case, and any costs incurred by the solicitor or the court can STILL be deducted from any eventual settlement.

Good advice, in fact in most cases you can get a free 20 minutes or so, it's called a diagnostic.
I dont claim on principle. Even following two car accidents which were not my fault. :(
But that doesnt mean I think you shouldnt, we all have our own principles.
I don't claim either - just my choice. Was badly shaken (though not injured) when a guy ran into the back of my car at a fair old rate. I'd been having neck problems - crash didn't make 'em any worse or better, but I was shocked by the number of people who said I could rip off a tidy sum for it - I didn't.
Same thing when the Pizza waitress dropped a hot pan on my arm - had a scar for a couple of years - not her fault, just an accident.
We all finish up paying - both in money and the timidity and fear of anyone helping each other ever.
I don't, however know your circumstances - no problem with claiming as long as it's not spurious.
netniV Mar 20, 2004, 23:55 Well, it's not 100% cast iron... or at least I'm not sure whether it is or not.
Basically, I exited a roundabout, noting the drive at the previous entrance to the roundabout was indicating left. I applied speed as when exiting said roundabout there is a small but steep hill and you can pick up decent speed there.
Car over takes with me on the inside of it, and at the bottom bit of hill indicates to turn left into car park with me still around his back passanger door, so I apply brakes (almost wrote breaks) to manouvere to behind him to cut right and go down the outside...
unfortunately I can't just slam on the brakes as I'm on said hill / just coming out of picking up serious speed, so need to apply them gentley enough NOT to lose control, manage to get behind but not enough to move to the right without clipping the last third of his boot as he is turning left.
So in all of this, I either continued at the speed I was at, and would have hit his passanger door, or tried to avoid an accident and unfortunately clipped his boot. Not sure whether my bike is damaged (need lintuk to nip up and have a look). Looks ok, but that can be deceptive on a bike.
I am in a cast on my left hand (writing hand, thus I can't sign for things). Also, it reduces what I can actually do drastically. typing this out would normally only take a couple of minutes, but has taken quite a while.
The result is, my bike might need work on it, which will cost a fair bit if it does. I've missed at least two days of work, plus other hospital time I'm going to need over the coming weeks. I have also since found out that I have a very increased risk of arthoritise (can't spell that). Plus my mobiley is broke :/ And because of all this, I can't use the bike so it is costing me a lot more per day in traveling.
I wouldn't want a lot of money if I went for compo, but I would accept it if given (who wouldn't). I would however like to know I can pay my bills next month without being seriously hampered. I think my overdraft is probably gonna get a lot nearer it's limit which is a worry... especially as I'm getting my debts down well, or was.

May still be worth pursuing though, I'd still go see a solicitor for an assesment either way.

I think that's why I am unsure whether to bother. However, I'll probably get in touch with the witnesses and find out what they saw (I have two addresses).

I myself am being sued by a former roommate of mine from college for damages to her face (a small scar about 3/4" long and one that actually looks like a zit) and also for damages that I don't feel could ever been proven. EMOTIONAL DISTRESS? what the hell is that all about? She said that she was unhappy with herself and that her social life was hindered by it. HELL SHE GOT FUCKING MARRIED to a guy that I introduced her to NONE THE LESS
either way, she wasn't much better looking before the accident, i'm sure the tiny cut didn't do to awful much to her face to make it worth sueing for. Hell, the insurance company offered her money for medical costs but she declined. She wanted to hold out for more and due to her lawyer being a evil cunt, she won't be getting any. Due to satute of limitations, her lawyer fucked up BIG TIME!!!!!

Most solicitors up here in North will give you a free one hour consultation Netters. Most compensation claims take at least a year to 18 mont to complete. Arthritis is the word you was looking to spell i think.:)
